Foundry Co. ("we," "us," or "our") operates the website foundryco.netlify.app (the "Site"). This Privacy Policy explains what information we collect, how we use it, and the rights you have regarding your information. By using the Site or placing an order, you agree to the practices described in this policy.
1. Information We Collect
Information you provide directly: when you submit our order form, we collect your name, business name, email address, industry, service and package selections, details about your business, and — for website clients — any payment method information you choose to have displayed on your website.
Payment information: payments are processed by Stripe. We never see or store your full card number, and all payment data is handled under Stripe's own privacy policy and security standards.
Technical information: like most websites, our hosting provider may automatically log basic technical data such as IP address, browser type, and pages visited.

We do not sell your personal information, and we do not share it with third parties for their own advertising or marketing purposes.
3. Third-Party Services We Use
We rely on a small number of service providers to operate: Formspree (order form processing), Stripe (payment processing), Netlify (website hosting), and Google/Gmail (email communication). Each of these providers processes data under its own privacy policy. We only share the information necessary for them to perform their function.
4. Data Retention and Deletion
We keep order and customer information for as long as reasonably needed for business, accounting, and legal purposes. You may request deletion of your personal information at any time by emailing us, and we will honor the request unless we are required to retain certain records by law.
5. Your California Privacy Rights
If you are a California resident, you have the right to request to know what personal information we have collected about you, to request that we correct inaccurate information, and to request deletion of your personal information. We will never discriminate against you for exercising any of these rights. We do not sell or share personal information as those terms are defined under California law.

6. Children's Privacy
Our services are intended for business owners and are not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
7. Website Client Content
If you order a website from us, information you provide for display on that website (such as your business name, contact details, and payment handles) will be published publicly at your direction as part of the deliverable.

1. Acceptance of These Terms
These Terms of Service ("Terms") are an agreement between you and Foundry Co. ("we," "us"), an independently operated business based in Orange County, California. Foundry Co. is not a registered corporation or LLC. By placing an order or using this Site, you agree to these Terms. If you are ordering on behalf of a business, you represent that you have authority to bind that business.
2. Our Services
Foundry Co. provides two services: (a) custom business documents, including SOPs, business plans, client intake forms, operations manuals, pricing sheets, and company profiles; and (b) custom website design with ongoing hosting provided as a subscription.
3. No Legal Documents or Legal Advice
Our documents are provided for organizational and informational purposes only. We do not draft contracts, agreements, waivers, or any other legal documents, and nothing we deliver constitutes legal, financial, or professional advice. No attorney-client relationship is created. You are solely responsible for ensuring your business materials comply with the laws that apply to your business.
4. Orders and Payment
Full payment is due before work begins. Payments are processed securely by Stripe. Prices are as displayed on the Site at the time of purchase. Submitting the order form and completing payment together constitute a confirmed order.
5. Document Delivery and Revisions
Documents are typically delivered within 24 hours of receiving your completed order and all required information. Revision allowances depend on your package: Starter includes 1 revision, Business includes 2 revisions, and Premium includes unlimited revisions for 7 days after delivery. A revision is an adjustment within the original scope of the ordered document — it is not a new or different document.
If we miss the stated delivery timeframe for reasons within our control (excluding delays caused by missing or incomplete information from you), you are entitled to a credit for one comparable document at no charge.
6. Website Services and Hosting
Websites are typically delivered within 3 business days of receiving all required information. Timelines are extended by any period in which we are waiting on content, feedback, or approvals from you. Your subscription includes design, delivery, and hosting of your live site.
You are responsible for the accuracy and legality of all content and information you provide for display on your website, including any payment method details. If you do not provide a payment method, your site will direct customers to contact you by phone or email.
Hosting is provided on reliable third-party infrastructure. Brief outages outside our control may occasionally occur, and we are not liable for downtime caused by third-party providers.
7. Subscriptions, Auto-Renewal, and Cancellation
Website subscriptions automatically renew — monthly plans each month and yearly plans each year — until cancelled. You may cancel at any time by emailing foundryco.hq@gmail.com from the email address on your account. Cancellation takes effect at the end of your current billing period, and your website remains live until then. If a renewal payment fails and is not resolved within 7 days, we may take your website offline until payment is restored.
8. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms and available from the footer of this Site.
9. Intellectual Property
Upon full payment, delivered documents are yours to use for your business. For websites, we retain ownership of the underlying code and grant you a license to your website for as long as your subscription is active; your business content always remains yours. We may display non-confidential samples of completed work for portfolio purposes unless you ask us not to.
10. Acceptable Use and Right to Refuse
You agree not to use our services for any unlawful purpose. We reserve the right to decline or cancel any order at our discretion, including requests for legal documents or content we consider unlawful, deceptive, or inappropriate. If we cancel an order before work begins, you will receive a full refund.
11. Disclaimers
Except for the express commitments stated in these Terms and on the Site, our services are provided "as is." We do not guarantee any particular business outcome, revenue, or results from the use of our documents or websites.
12. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of these Terms or our services is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost profits.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Orange County, California, and you consent to that venue.
California residents: if a complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.

Refund Policy

We want every client to be happy with their order. This policy explains when refunds are available for each of our services.
1. Document Orders
If you cancel before work on your document has begun, you will receive a full refund.
Once your document has been delivered, the order is non-refundable. Instead, your package's included revisions apply, and we will revise the document within your revision allowance until it meets the original order scope.
If we miss the 24-hour delivery timeframe for reasons within our control, your next document is free.
2. Website Subscriptions — Monthly
You may cancel at any time by emailing foundryco.hq@gmail.com.
Cancellation takes effect at the end of your current billing period, and your website stays live until then.
Payments already billed for the current period are non-refundable.
3. Website Subscriptions — Yearly
If you cancel within 7 days of your initial yearly purchase and your website has not yet been delivered, you will receive a full refund.
After your website has been delivered, yearly payments are non-refundable, but your website remains live through the end of the paid year.
Yearly plans do not renew after cancellation.
4. Failed Payments
If a subscription payment fails, we will attempt to notify you. If the payment is not resolved within 7 days, your website may be taken offline until payment is restored. Going offline for non-payment does not entitle you to a refund of prior payments.
5. How to Request a Refund
Email foundryco.hq@gmail.com with your name, business name, and order details. We respond to all refund requests within 2 business days.
6. Processing Times
Approved refunds are issued to your original payment method through Stripe and typically appear on your statement within 5–10 business days, depending on your bank.
